Since March 12, 2016, voluntary resignations by private sector employees, as well as mutually agreed terminations of employment, must be communicated to the employer exclusively electronically and using specific forms provided by the Ministry of Labor. Resignations submitted in any other manner are ineffective. Using the same procedure, resignations may be revoked no later than seven days after submission.

Who is it concerned with?

All private sector employees with permanent, fixed-term, or other types of contracts.

Who does not concern

  • Domestic workers with a collaboration contract, on internships.

  • Seafarers and public employees.

  • Resignations or consensual resolutions signed during transitions at the Territorial Labor Directorates.

  • The resignation of a female worker during pregnancy or in the first three years of the child's life must still be validated by the Territorial Labor Inspectorate

  • The resignation of the father worker in the first three years of the child's life which must still be validated by the Territorial Labor Inspectorate

With reference to the last two points, we remind you that the employee must present to the employer a standard letter of resignation written in his/her own hand and, only subsequently , go to the Inspectorate for validation.

Necessary documentation

  • Valid identity document

  • Last (or one of the last) pay slips relating to the employment relationship you intend to terminate

  • Email address and/or certified email of the company with which you have an ongoing employment relationship that you wish to terminate

  • Company Tax Code or VAT Number

  • Worker's email address

  • Tax code of the worker

  • Effective date of resignation (the first day of “not working”) taking into account the notice period.

  • Employment contract
